CPN BREAKFAST BRIEFING - Is law reform leaving your clients/suppliers of goods and services at risk?

The laws in relation to the Australian Insolvency industry (corporate and personal insolvency) are in the process of their most extensive reforms experienced since 2001. The introduction of these changes is to encourage entrepreneurship in Australia. These reforms not only affect the insolvent but also have material implications for suppliers of goods and services to entities that subsequently become insolvent.

It is imperative that you and your clients are aware of these changes in order to maintain the best possible protection from events of default.

Our team will be presenting to you on these reforms, which have been partly introduced as part of the Treasury Laws Amendment (2017 Enterprise Incentives No.2) Act, and offer some guidance from a supplier perspective.

In particular, we will discuss the following reforms:

  • Safe Harbour for directors (introduced in September 2017);
  • Prohibition on enforcement of Ipso Facto clauses (to apply from 1 July 2018);
  • Bankruptcy Amendments (to apply 6 months after the Act receives Royal Assent);
  • Phoenix Activity Law Reform (currently at Federal Government proposal phase).
